01About us & these terms

This website, parkmerdok.uk (the “Site”), is operated by Parkmerdok Ltd (“Parkmerdok”, “we”, “us”, “our”), a private limited company registered in England & Wales under company number 15329764, with its registered office at Studio 3, The Glasshouse, 27 Alder Row, Bristol BS1 5TF. Our VAT number is GB 438 2917 04.

These Terms of Service (“Terms”) govern your use of the Site and any plants, installations, workshops or other goods and services we supply through it. By using the Site or placing an order, you confirm that you accept these Terms. Please read them carefully; if you do not agree with them, please do not use the Site.

02Definitions

• “Order” means a request by you to purchase Products from us.
• “Products” means the plants, plant boxes, installations, workshop places and related goods we offer through the Site.
• “Subscription” means a recurring seasonal plant box arranged through the Site.
• “Contract” means the legally binding agreement between you and us for the sale and purchase of Products.

03Using our website

You may use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict the use and enjoyment of the Site by, anyone else. The Site is intended for users who are at least 18 years old and resident in the United Kingdom.

We may update or withdraw the Site, or restrict access to all or part of it, at any time and without notice. We do not guarantee that the Site, or any content on it, will always be available or uninterrupted.

04Products, boxes & workshops

Plants are natural, living products. Colour, size, form and finish will vary from any images shown, and every plant is unique — this is part of their charm rather than a defect. Vessels are frequently reclaimed and may carry gentle marks of previous life.

Workshop places are limited and are confirmed only once payment is received. Where a workshop includes materials, those materials are yours to take home. We may substitute a plant or vessel of equal or greater value where the specific item is unavailable, and will tell you if we do so.

05Orders & payment

Your Order is an offer to buy from us. A Contract is formed only when we send you an order confirmation by email. If we cannot accept your Order — for example, because a Product is out of stock, we cannot deliver to your area, or there was a pricing error — we will let you know and will not charge you.

Prices are shown in pounds sterling (GBP) and include VAT where applicable. Delivery charges, where they apply, are shown before you place your Order. Payment is taken through our third-party payment provider at the point of Order (or, for a Subscription, at the start of each billing period). We do not store your full card details.

06Delivery

We currently deliver within the Bristol area by cargo bike, and by tracked courier elsewhere in mainland Great Britain. Estimated delivery windows are given in good faith but are not guaranteed. Risk in the Products passes to you on delivery; ownership passes once we have received payment in full.

If no one is available to receive a live plant and it cannot be left safely, we may need to arrange re-delivery, which could incur a further charge.

07Cancellation & returns

For most Products bought at a distance you have the right to cancel within 14 days of receiving them, under the Consumer Contracts Regulations 2013, and to receive a refund. To cancel, email hello@parkmerdok.uk with your order number.

Please note the usual legal exceptions: this right does not apply to goods that are liable to deteriorate or expire rapidly (which can include certain living plants), or to workshop places for a specific date once that date has passed. If a plant arrives damaged, unwell or not as described, contact us within 48 hours with a photo and we will replace it or refund you — this is in addition to your statutory rights.

08Managing a subscription

Seasonal plant box Subscriptions renew automatically each season until cancelled. You can pause, skip or cancel at any time from your account or by emailing us, with no cancellation fee. Cancellation takes effect at the end of the current paid season; we do not pro-rate part-seasons.

09Intellectual property

All content on the Site — including text, photography, illustrations, the Parkmerdok name and logo, and the overall design — is owned by or licensed to Parkmerdok Ltd and is protected by intellectual property laws. You may view and share it for personal, non-commercial use, but you may not reproduce, adapt or exploit it commercially without our prior written permission.

10Acceptable use

You agree not to misuse the Site, including by introducing malicious code, attempting to gain unauthorised access, scraping content at scale, or using it in any way that is unlawful, fraudulent, or harmful.

11Our liability

We do not exclude or limit our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for losses that were not foreseeable, or for any loss or damage that was not caused by our breach of these Terms. If we are liable for loss or damage, our total liability will not exceed the total amount you paid for the relevant Products.

Plants are living things and depend on care and conditions we cannot control once they leave us; we cannot guarantee that any plant will survive indefinitely.

12Events outside our control

We are not responsible for delays or failures to perform caused by events beyond our reasonable control, including extreme weather, supply shortages, transport disruption or similar. If such an event occurs, we will contact you and, where necessary, agree a new delivery date or offer a refund.

13Changes to these terms

We may update these Terms from time to time to reflect changes in our Products, our practices, or the law. The version in force is the one published on this page, with the “Last updated” date shown above. Orders are governed by the Terms in force at the time the Contract is formed.

14Governing law

These Terms, and any dispute arising out of or in connection with them, are governed by the laws of England & Wales, and are subject to the non-exclusive jurisdiction of the courts of England & Wales.
